### Privacy

At Organna Data LLC, we are committed to protecting your privacy. For information on how we collect, use, and safeguard your personal data, please refer to our Privacy Policy.

### Phone Numbers

After purchasing a service package from ACpay, you will select one or more phone numbers for your account. These numbers remain the property of ACpay.org, and their use is subject to our discretion. If a phone number is unused, ACpay reserves the right to deduct minutes from your balance. You may cancel any service at any time to avoid deductions. Specifically, 29 minutes will be deducted every 30 days for unused numbers. For example, if a number is used for 24 minutes within a 30-day period, 5 additional minutes will be deducted from your balance.

### Auto Protect

All accounts must have a valid credit card on file for the Auto Protect system. When your balance is low, your selected service package will be automatically charged. If your usage indicates that you will run out of minutes within three days, or if your account falls below 50 minutes, the system will charge your card overnight. You will receive three email notifications in advance. Accounts cannot run into negative balances. If your account goes negative during the day, the balance will be charged along with your selected package.

### Service

Minutes purchased from ACpay.org are valid for the duration of your campaign or future campaigns, should there be a remaining balance. Minutes expire two years from the date of purchase. Set-up fees, training fees, and fees for custom reports or technology integration are non-refundable. Unused minutes are refundable upon request. If services are terminated, any refund from the first month’s payment is subject to a 20% service fee.

### Client Charges and Rate Plans

Initial set-up fees cover up to two hours of set-up, project design, training, and scripting. Additional hours for scripting will be billed at $150 per hour, and additional training will be billed at $27 per hour per agent. Technology integrations and custom reporting will be billed at $150 per hour. On holidays (New Year’s Day, President’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, and Christmas Day), 30 minutes will be deducted from your account.

### Credit Card Charge Backs or Holds

If you request a chargeback from your credit card company, your account will be disabled, and any associated phone numbers will be released. To restore your account, the chargeback must be removed, and a $25 processing fee will apply. There is no guarantee that you will be able to use the same phone numbers after account disablement.

### Registration

Upon registration, you will create a username and password for your account. You are responsible for maintaining the confidentiality of your credentials and are accountable for all activities under your account.

Note that ACpay.org is a general audience website, and by registering, you confirm that you are at least 13 years old. If you are under 13, do not register or provide personal information.

### Content Submitted to ACpay

You represent that you own or control the rights to any content you upload to ACpay’s system. This content must be accurate, and its use must not violate these Terms of Use or cause harm. You agree to indemnify ACpay for any claims arising from your content. Information collected by ACpay on your behalf will not be shared with third parties without consent unless legally required. If using our salesforce.com integration, collected information will be shared with salesforce.com.

### Campaigns

ACpay will only accept campaigns that represent honest, ethical activity. If we determine that any activity is unethical or illegal, we reserve the right to cease services immediately. ACpay owns any toll-free numbers provided during campaigns, and they may not be used after campaign termination.

### Trademarks

All trademarks, including “ACpay.org” and related designs and logos, are the property of ACpay.org. You agree not to use any of these trademarks in commerce without prior written permission. All other trademarks on this website are the property of their respective owners.

### Notice of Intellectual Property Infringement

If you believe that your intellectual property has been infringed upon, please provide the following information to ACpay’s Copyright Agent:

1. An electronic or physical signature of the owner or authorized person.
2. A description of the work being infringed.
3. A description of where the material is located on our website.
4. Your contact information (address, phone number, email).
5. A statement of good faith belief regarding the unauthorized use.
6. A statement made under penalty of perjury that the information is accurate.

### Indemnity

You agree to indemnify and hold ACpay, its affiliates, officers, agents, employees, and partners harmless from any claims arising from content you submit, your use of ACpay’s services, or violation of any laws or third-party rights.

These Terms of Use constitute the entire agreement between you and ACpay and supersede any prior agreements. You may be subject to additional terms when using other ACpay services.

– *Governing Law and Forum:* These terms are governed by the laws of the State of Wyoming, and any disputes must be resolved in Sheridan County.
– *Modification:* ACpay reserves the right to modify policies, the website, and these Terms of Use at any time. Significant changes will be posted, and users must review and accept the updated Terms of Use before accessing services.

ACpay makes no warranties regarding the error-free nature of its services. ACpay is not liable for system malfunctions or failures caused by factors beyond its control.
